Mountain Ram Adventures P. Ltd. is a registered company incorporated under the laws of Nepal with registered office address at Z Street Thamel, Kathmandu, Nepal (the “Company”).

These Terms and Conditions governs the legal relationship between the Company and you (the “Client(s)”) in organizing the tour, trek or climbing expeditions (the “Trip(s)”).

The Company accepts the Client’s bookings under the terms and conditions set forth below.

1. ADVANCE-PAYMENTS AND BANK DETAILS

A 20% non-refundable advance payment (the “Advance Payment”) is required to make a booking. Once the Company receives the Advance Payment, the Company will proceed with the logistical arrangements for the applicable Trip.

The Clients must have a passport with six (6) months’ validity from their return date. Nepalese visas and related costs are the responsibility of the Client. All necessary documentations as communicated by the Company to the Client must be presented to corresponding authorities and to the Company prior to the commencement of the tour.

We accept payments by Western Union, bank transfer (see bank details below) as well as Visa or Master credit cards or cash (either American dollars or Euro)

2. PAYMENT TERMS

The remainder of the outstanding balance (i.e., the total cost of the Trip less the Advance Payment ) may be paid by the Client to the Company upon arrival in Nepal. Please note that if the Client chooses to pay by credit card, a service fee will be applicable by a Nepalese bank on the outstanding balance. In circumstances where payment is made through Western Union or bank transfer, corresponding Western Union or bank fees apply.

3. LAST-MINUTE BOOKINGS

We accept last-minute bookings up to 48 hours before the Trip. This is conditional only upon 100% cleared payment of the full Trip in Nepal.

For Trips in Bhutan and Tibet, last minute bookings can be made seven (7) days’ prior to the commencement of the Trip. This is conditional only upon 100% cleared payment of the full Trip.

Please note these payments are non-cancellable and non-refundable.

4. REFUNDS BOOKING AMENDMENTS AND CANCELLATION  FORMALITIES

The Advance Payment set out under clause 1 of these Terms and Conditions is non-refundable.

The Client is entitled to a refund of the full amount (save for the Advance Payment) prior to the commencement of their Trip. For all refunds, written notification of any cancellations must be sent to the Company within 48 hours prior to the commencement of the Trip. A refund will be made by the Company to the Client after deduction of applicable charges including but not limited to tax, transportation and permits.

No refunds will be made if the Client cancels after 48 hours or for any last minute cancellations.

For any amendments to popular tourist destinations (Everest, Annapurna or Langtang), will require fifteen (15) days’ prior written notice. For any other amendments, the Company will require at least eight (8) weeks’ prior written notice.

For the avoidance of doubt, please note that once the Trip commences, no refunds will be made to the Client.

5. FORCE MAJEURE

The Company will not be liable for any failure, delay or non-performance of its obligations under these Terms and Conditions that is due to events beyond its reasonable control including but not limited to acts of God, wars, riots, pandemics, natural disasters, conflict, unfavorable climate conditions or flight delays. The Company will use reasonable endeavors to refer the Client to an alternative Trip of similar type and category as soon as reasonably practicable. Should this not suit the Client’s plan or schedule, the cost of the Trip (save for the Advance Payment set out under clause 1) will be refunded to the Client. However, the Company will not be liable to the Client for any other ancillary, miscellaneous or related expenses and costs incurred as a result of the booking and the Client agrees that such expenses and costs are entirely the Client’s responsibility.

6. MODIFICATION OF THE TERMS AND CONDITIONS

The Company may revise these Terms and Conditions and pricing at any time without prior notice.

7. CLIENTS RESPONSIBILITIES

A guide will be provided to the Client who will accompany each Client or group during the Trip. In proper performance of the services, the guides will exercise the degree of skill, care and diligence normally exercised by their profession in performing services of a similar nature. The guides provided by the Company are licensed and qualified for tours, trekking and climbing and possess the standard of skills and experience required for proper performance and discharge of their duties and responsibilities.

If a Client or a group commits any unlawful act or deviates from the advise given by our guides putting themselves and other members of the group under risk, danger or uncertainty, our Company reserves the right to remove the Client from the Trip with immediate effect. No refunds will be made in such a cases and the Company shall have no liability to the Client as set out under clause 9 of these Terms and Conditions.

8. TRAVEL INSURANCE

The Client is strongly advised to purchase a comprehensive travel and/or medical insurance package prior to the beginning of the Trip covering unforeseen incidents, natural calamities, disasters, helicopter evacuation, personal accidents or Trip cancellations.

9. LIABILITY

To the fullest extent permitted by applicable law, the Company, its directors, employees, officers, agents, guides and porters exclude and disclaim liability for any losses, expenses, damages whether financial or otherwise that the Client may suffer whether in contract or tort.

10. PERSONAL BELONGINGS

The Company shall have no responsibility for any loss, damage or theft of the Client’s luggage or property belonging to them during the Trip howsoever caused. We highly recommend that each Client uses the secure storage facilities of their guesthouse/hotel in Kathmandu or Pokhara for their personal items not required during the Trip. It is advisable only to bring only such items or equipment necessary for the Trip. During the tour, it is each Client’s personal responsibility to take care of their belongings.

11. FLIGHT DELAYS/CANCELLATIONS

There is always a possibility of local flight delays or postponement due to unpredictable weather conditions in the Himalayas. For trekking in remote areas, especially during the off-season period (i.e., April to October), the Client is strongly advised to reserve extra days for potential flight and other delays to avoid disappointments. In case of flight cancellations either prior to or after the completion of the Trip, the Client will be responsible for their own cost of accommodation and food.

12. COMPLAINTS AND PROBLEMS

If the Client has any complaints or is dissatisfied with the Trip, they must inform their guide at the earliest opportunity. The guide will then take the appropriate action necessary to resolve the issues.

13. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed and construed in accordance with Nepalese laws. The Client irrevocably agrees that the courts of Nepal shall have exclusive jurisdiction to settle any disputes which may arise out of, under or in connection with these Terms and Conditions or the legal relationship established by them, and for those purposes irrevocably submits all disputes to the jurisdiction of the Nepalese courts.
